During his first three months in office, Merrick Garland had opportunities to reverse the corrupt policies of his predecessor William Barr, but failed to do so. Instead, he has allowed the DOJ to continue the Trump / Barr DOJ.

Merrick Garland has proven unfit to be the United States Attorney General by failing to Arrest and Prosecute Trump for his numerous crimes, defending Trump in the E. Jean Carroll defamation case and fighting release of the full memo on Trump’s Obstruction of Justice (which Americans has a right to see).

Garland’s Justice Department declined to reverse course on one of the most egregious abuses of the department under Barr: its attempt to take on the legal defense of Trump in a defamation suit filed by magazine columnist E. Jean Carroll.

 

 

Judge Warns of DOJ’s Gift to Trump That Could Keep on Giving

“I think it’s a legitimate concern. What the judge is getting at is the very real possibility of unforeseen consequences,” said Vermont Law School professor Jared Carter.

Per the above article; “A judge has warned that former President Donald Trump is building a legal shield that could block him from being held accountable for inciting the Jan. 6, 2021, insurrection, pointing to the bizarre move by the Department of Justice to side with Trump in a rape defamation case last year.

The DOJ’s legal stance—that anything a president does is part of his official duties, and therefore makes him a federal employee immune to lawsuits—was widely criticized at the time. But it came up again on Tuesday, when a federal appellate judge found it necessary to issue a stark warning that obviously referred to holding Trump accountable.

“Under this logic, so long as a president looks like he is engaged in conduct that is of the kind he is expected to perform—like speaking to a reporter or attending a government meeting—he is acting in the scope of his employment. But if that were so, then the mere presence of others would neutralize whatever a president did or said, for no president could be held accountable for damage done in front of a microphone or in an official meeting—whether defaming a citizen, exposing classified national security information, or inciting a riot,” wrote Judge Denny Chin in New York City.

“This is not, and should not be, the law,” he added”.

Donald Trump should be facing prosecution for a half dozen crimes, according to a pair of legal experts, but instead he’s preparing for another presidential run that he just might win.

The twice-impeached president has raised $122 million, more than twice the amount of the Republican National Committee, ahead of the 2024 presidential campaign that he shouldn’t even be eligible to take part in, argued former White House ethics attorney Richard Painter in a new column for MSNBC.

“The 14th Amendment, Section 3, disqualifies from public office anyone who took an oath of loyalty to the United States and shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof,” Painter argued in a forthcoming law review article with Claire Finkelstein, a law professor at the University of Pennsylvania.

“Crimes for which Trump could be indicted include but are not limited to,” Painter and Finkelstein wrote,

“(1) obstructing justice as identified in the Mueller investigation

(2) bribing and/or extorting Ukraine with military aid to investigate his political opponent Joe Biden and conduct another investigation undermining the Mueller investigation,

(3) coercing cabinet members and other federal employees to engage in partisan political activity in violation of the criminal political coercion provisions of the Hatch Act,

(4) soliciting election fraud in a phone call to the Georgia Secretary of State in November 2020,

(5) criminal sedition in authorizing preparation of the unsigned draft Executive Order dated December 16, 2020 pursuant to which President Trump would have ordered the Secretary of Defense to seize voting machines in certain states to look for evidence of election fraud, and

(6) inciting insurrection at the Capitol on January 6, 2021. These alleged politically-related crimes are over and above the financial crimes being investigated by the Manhattan DA, who has already indicted the Trump Organization and its chief financial officer.”

New reports revealed the Barr DOJ was investigating members of the Press and Congressman (and staff) critical of Trump such as Adam Schiff. From what we’re seen thus far, it appears Garland is too timid to hold Trump or anyone in his administration accountable for crimes they may have committed.

We need an Attorney General who will aggressively stand for the rule of law, clean house at the DOJ and hold law breakers accountable.

The Merrick Garland Justice Department offered two of Ahmaud Arbery’s killers plea deals on hate charges.

Arbery family attorney Lee Merritt said in a statement late Sunday that Arbery’s parents, Wanda Cooper-Jones and Marcus Arbery, “vehemently” oppose the deals and said so directly to the U.S. Justice Department earlier in the day.

The deals, Merritt said, would let the McMichaels serve the first 30 years of their terms in “a preferred federal prison.” Merritt said that would be a “huge accommodation” to “the men who hunted down and murdered” Arbery. He added that Arbery’s family is “devastated” over the proposals and “their wishes are being completely ignored.”

Merritt quoted Cooper-Jones as saying, “The DOJ has gone behind my back to offer the men who murdered my son a deal to make their time in prison easier for them to serve. … I have been completely betrayed by the DOJ lawyers.” Assistant Attorney General Kristen Clarke told CBS News on Monday that the Department of Justice “entered the plea agreement only after the victims’ attorneys informed me that the family was not opposed to it.” Merritt said Cooper-Jones would appeal to the court Monday to throw out the deal.

Earlier this month, the DOJ approached Cooper-Jones about a plea bargain that would have both McMichaels admitting that what they did was motivated by hate, according to Merritt. Cooper-Jones told “CBS Mornings” she rejected the deal because she wants the men to stand trial in court for those charges.
