On Friday morning, MSNBC’s “Morning Joe” host Joe Scarborough and co-host Willie Geist accused Vice President Mike Pence and the 106 Republican House members who signed onto Donald Trump’s attack on the 2020 presidential election of committing sedition and treason against the people of the United States.

Rep. Bill Pascrell (D-N.J.) is asking House Speaker Nancy Pelosi (D-Calif.) to refuse to seat members of the next Congress who backed President Trump’s effort to challenge the election. Pascrell argues that the 14th Amendment prohibits members of Congress from rebelling agains the U.S., and “trying to overturn a democratic election and install a dictator seems like a pretty clear example of that.”

 

“Section 3 of the 14th Amendment was written after the Civil War to bar from government any traitors who would seek to destroy the Union. My letter to House leadership today demands that 126 Republicans (and counting) are violating the Constitution”.

The text of the 14th Amendment expressly forbids Members of Congress from engaging in rebellion against the United States. Trying to overturn a democratic election and install a dictator seems like a pretty clear example of that.

Pelosi’s office didn’t comment on Pascrell’s request, but in a Dear Colleague letter sent Friday evening, Pelosi said the Republicans are “subverting the Constitution by their reckless and fruitless assault on our democracy which threatens to seriously erode public trust in our most sacred democratic institutions, and to set back our progress on the urgent challenges ahead.”

As the Pennsylvania Attorney General said in his state’s response to the suit, it’s a “seditious use of the judicial process…”

There are laws prohibiting rebellion, but in the 14th Amendment, the Constitution specifically prohibits anyone from sitting in the House or the Senate who having sworn an oath of loyalty to the union, has actively taken part in, or merely supported, attacks on its structures and operations.

Congressman Bill Pascrell of New Jersey wrote to Speaker Pelosi Friday telling her she should investigate how to enforce this constitutional clause and not seat the seditious 126 in the new Congress next month. She might not be able to do it, but she needs to try, because these Republicans need to be taught that standing with Trump against elections and democracy will taint them for life”.
